These Website Terms of Use (“Terms”) govern access to oceanlabs.one (the “Site”), operated by Ocean Labs LLC. By using the Site, you agree to these Terms and our Website Privacy Policy. If you do not agree, do not use the Site.

The Site provides information about Ocean Labs LLC and links to products we own and operate. Product websites, applications, subscriptions, hosted services, and open-source projects may have separate terms, privacy notices, licenses, and eligibility requirements. Those product-specific terms govern your use of the applicable product.

You may use the Site for lawful informational and business purposes. You may not interfere with the Site, attempt unauthorized access, introduce malicious code, misuse automated systems, misrepresent your affiliation with us, infringe another person’s rights, or use the Site in violation of applicable law.

The Site and its text, design, branding, graphics, and other content are owned by or licensed to Ocean Labs LLC and are protected by applicable intellectual-property laws. These Terms do not grant a license to use our names, logos, or trademarks.

Software identified as open source is governed by the license distributed with the applicable repository or package. If these Terms conflict with an applicable open-source license regarding that code, the open-source license controls for the code.

Links to product sites, repositories, social platforms, and other third-party services are provided for convenience. We do not control third-party services and are not responsible for their availability, content, security, or practices. A link does not imply endorsement unless we expressly say so.

To the fullest extent permitted by law, the Site is provided “as is” and “as available.” Ocean Labs LLC disclaims all express and implied warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, and that the Site will be uninterrupted, secure, accurate, or error-free.

Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you. Nothing in these Terms limits non-waivable consumer rights.

To the fullest extent permitted by law, Ocean Labs LLC and its members, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business opportunity arising from the Site.

To the fullest extent permitted by law, our aggregate liability arising from the Site will not exceed one hundred U.S. dollars (US $100). These limitations do not apply where liability cannot lawfully be limited or excluded.

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Ocean Labs LLC and its members, employees, contractors, and agents from claims and expenses arising from your unlawful misuse of the Site or violation of these Terms or another person’s rights.

We may modify, suspend, or discontinue any part of the Site and may update these Terms. Revised Terms are effective when posted with a new effective date and apply prospectively. Your continued use after they take effect constitutes acceptance.

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Except where applicable law gives you the right to bring a claim elsewhere, any dispute arising from the Site will be subject to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California.

If a provision of these Terms is found unenforceable, it will be modified to the minimum extent necessary and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, financing, merger, acquisition, or sale of assets.
